By accessing or using the AuthentiKid website (authentikid.com), our compliance infrastructure products (AuthentiKey™, EduLock™, AuthentiLock™, MasterEduKey™), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
These Terms constitute a legally binding agreement between you and AuthentiKid, Inc. ("AuthentiKid," "we," "us," or "our"). If you are using the Services on behalf of an organization — including a school district, enterprise, or platform — you represent that you have authority to bind that organization to these Terms.
The Services are intended for use by adults (18 years of age or older) acting on behalf of themselves, their organizations, or the children in their care. AuthentiKid does not knowingly permit minors to create accounts or enter into agreements directly. If you are a minor, please have a parent, guardian, or authorized school administrator use the Services on your behalf.
AuthentiKid provides a privacy-first digital identity and age-group verification infrastructure designed to protect minors online. Our Services include:
• AuthentiKey™ — A free digital identity token for minors that verifies age-group status to participating platforms without transmitting personally identifiable information. • EduLock™ — A district-wide compliance control layer for school administrators and superintendents. • AuthentiLock™ — An enterprise-grade compliance enforcement layer for platforms and developers. • MasterEduKey™ — A superintendent-level oversight and audit tool. • Know Your Minor™ (KYM) SDK — A developer integration for age-group verification. • The Digital Village — A network of verified stakeholders collaborating to enforce child safety standards across platforms. • Moral Mirror Challenge — A free weekly digital ethics engagement tool.
AuthentiKey™ is and will remain free for all families and schools. AuthentiKid's revenue model is based on enterprise and platform licensing — not on monetizing user data. Paid services, including enterprise SDK licensing and district-level compliance tools, are governed by separate written agreements between AuthentiKid and the contracting organization.
You may use the Services for lawful purposes consistent with these Terms and all applicable local, state, federal, and international laws and regulations. You may access and use the Services for personal, educational, or organizational purposes as intended.
You agree not to:
• Attempt to circumvent, reverse-engineer, or tamper with any age-verification, authentication, or compliance mechanism within the Services. • Use the Services to collect, harvest, or aggregate personal data about minors. • Impersonate any person, organization, or entity, or misrepresent your affiliation with any school, district, or enterprise. • Use the Services to transmit malware, spam, or any harmful or disruptive code. • Attempt to gain unauthorized access to any portion of the Services, including other users' accounts or AuthentiKid's backend systems. • Use the Services in any manner that could harm, exploit, or endanger children. • Resell, sublicense, or commercially exploit the Services without a written agreement with AuthentiKid.
All content, technology, trademarks, trade names, service marks, logos, and intellectual property associated with the Services — including AuthentiKey™, EduLock™, AuthentiLock™, MasterEduKey™, Know Your Minor™, AuthentiLock™, the Digital Village, and Moral Mirror Challenge — are the exclusive property of AuthentiKid, Inc. or its licensors. Nothing in these Terms grants you any right, title, or interest in AuthentiKid's intellectual property beyond the limited license to use the Services as described herein.
Subject to your compliance with these Terms, AuthentiKid grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. This license does not include the right to copy, modify, distribute, sell, or create derivative works from any part of the Services without AuthentiKid's prior written consent.
If you provide AuthentiKid with feedback, suggestions, or ideas regarding the Services, you grant AuthentiKid a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation or attribution to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. AUTHENTIKID DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTHENTIKID, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF AUTHENTIKID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL AUTHENTIKID'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AUTHENTIKID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless AuthentiKid, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party rights.
AuthentiKid reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify users via email or a prominent notice on the website. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
AuthentiKid reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason — including violation of these Terms. Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Indiana.
